Automobile Collision

The Law Offices of William K. Goldfarb offers legal services for injured victims of serious vehicle, truck and biking accidents. Every year millions of people are injured in motor vehicle collisions, many very seriously. In fact, according to the National Highway Traffic Safety Administration, every 10 seconds someone in the United States is involved in an Automobile Collision.

The courts of our state look to a number of factors in determining whether a driver was negligent. Some examples of these factors include, but are not limited to, the following:

  • Driving too fast
  • Driving under the influence of drugs or alcohol
  • Failing to signal while turning
  • Disregarding weather or traffic conditions
  • Disobeying traffic signs or signals
  • Failing to drive on the right side of the road

In all collision cases it is essential that measures be taken immediately to preserve evidence, investigate the collisions in question, and enable physicians or other experts to thoroughly evaluate any injuries.

Sample Case

A Cabarrus County resident traveling through Kentucky was involved in a single car collision as a passenger. As a result of the negligent actions of the vehicle’s driver, the passenger in the collision sustained multiple serious and life threatening injuries including, a broken right femur and lacerated liver. In addition to the passenger’s life threatening injuries, she also received multiple lacerations and bruises, chipped teeth, and a broken right wrist. Subsequent medical treatment as a result of the collision included five surgeries and a bone graft from hip to right wrist. A lawsuit was filed in Kentucky against the negligent driver’s insurance.

Case Result

This case was settled at mediation, resulting in the insurance tendering policy limits at $250,000.00 USD.

Personal Injury

At the Law Offices of William K. Goldfarb, our legal team has represented individuals and families in a wide variety of personal injury cases. It is important to remember that not all personal injury cases are the result of automobile collisions, oftentimes they involve slips and falls, dog bites, unsafe premises and nursing home abuse caused by the negligence, carelessness, or reckless acts of others.

We are experienced in handling large, complex personal injury cases involving catastrophic injuries, such as brain, neck and back injuries, spinal cord injuries such as paraplegia and quadriplegia, burns, and other severe and crippling conditions.

Sample Case

A Mecklenburg County resident and patron of Vinnie’s Sardine Grille in Matthews, North Carolina was severely beaten by an off-duty bouncer at the establishment. As a result of the beating at the hands of the off-duty bouncer, the patron suffered severe permanent scaring to the right side of his face and multiple abrasions and lacerations to the rest of his body. A lawsuit was filed against Vinnie’s Sardine Grille for failure to provide a safe premise, negligent training, supervision and negligent handling of the situation in question.

Case Result

This case was heard before a Mecklenburg County jury, wherein, the jury awarded the Plaintiff $5,320.00 USD in compensatory damages and $15,760.00 USD in punitive damages. The Defense appealed the jury verdict to the North Carolina Court Appeals; however, a divided Appeals Court affirmed the ruling, saying that the punitive damages award was proper. For Court of Appeals Ruling information on this case please see Miller v. B.H.B. Enterprises, Inc., d/b/a/ Vinnie’s Sardine Grille and Raw Bar, No.: COA-01-1282 (Mecklenburg County Docket No.:99-CVS-5469).

Product Liability

The Law Offices of William K. Goldfarb defend clients seriously injured by defective products. Every year, thousands of people sustain serious injuries from defective and dangerous products. Sadly, many of these injuries could be avoided if the manufacturers or distributors of these products took additional steps to ensure safety. Product Liability cases seek to provide compensation for injuries sustained from the use of defective and dangerous products. Product liability cases can be established if you are able to prove the following:

  • The product was defective
  • The defect existed prior to the manufacturer releasing the product
  • The defect caused you damages and/or injuries

Our mission at The Law Offices of William K. Goldfarb in pursuing product liability cases is to obtain just compensation for those injured by the negligent actions of product manufacturers and distributors, thereby creating incentives to produce safer products and provide sufficient warning of the dangers of their products, ultimately resulting in the saving of lives and limbs.

Sample Case

A Union County resident purchased a weed eater for use at his home from a local home improvement store. He used the product on two separate occasions with no issues. During the third use of the product in question, parts from the rotating spool broke free at a high speed ricocheting off the man’s house striking him in his eye. After having product inspected by an expert engineer, it was found that the parts broke free from the rotating spool because of inferior quality materials used in the manufacturing of the product in question. Sadly, the gentleman who suffered this accident has lost most all the vision in his right eye and is legally blind.

Case Result

A lawsuit was filed but this case was ultimately settled several weeks after the mediation for a confidential amount. The Manufacturer eventually recalled the product in question.

Wrongful Death

A wrongful death claim is a suit that arises from the death of an individual that was caused by the negligent conduct of another. A wrongful death suit is different from other types of personal injury claims because the actual victim (the “decedent”) is not bringing suit, rather it is the family members or the decedent’s estate. As such, a wrongful death claim is brought to recover damages for the injuries that the surviving family and/or estate suffered due to the death of the victim.

Sample Case

A landlord’s careless handyman failed to cap natural gas lines for a wall-heating unit that had been removed from a rental property. The new tenants, excited about their new home moved in unaware of the dangerous situation present in the house and had the all the utilities including the natural gas turned on. The gas leak quickly filled the house and lead to a catastrophic explosion, destroying the home and severely injuring the tenants and killing their infant daughter.

Nursing Home Negligence

The Law Offices of William K. Goldfarb seeks justice & truth for elderly people who are abused or neglected in nursing homes, nursing or assisted living facilities.

In the United States today, there are over thirty-six million people above the age of 65. According to statistics, many will need some form of assisted living, whether it is a nursing home, assisted living facility or other elderly facility. Due to the fact that long-term care for the elderly is typically extremely expensive (well over $5,000 per month in many areas), the vast majority of residents go through most, if not all, of their assets in a matter of months and then become eligible for federal Medicaid benefits. Indeed, the cost of over 90% of nursing home residents is paid by Medicaid. As such, almost all nursing home facilities receive Medicaid funds. According to the best available estimates, between 1 and 2 million Americans, age 65 or older have been abused in some way or another. Nursing home residents have patient rights and certain protections under the law.

Sample Case

An elderly woman was admitted to a nursing home for long term care after being diagnosed with dementia. Shortly after her admittance to the nursing home, she was rushed to the hospital suffering from a severely fractured right hip. The nursing home claimed that the elderly lady fell on her own, causing her own accident. Family of the elderly woman, leery of the nursing homes account of the accident ask the elderly lady if she could remember how she had come to injure her hip. The elderly woman told them that a staff member of the nursing home pushed her down. A subsequent investigation by the Department of Social Services revealed the injury to be a result of “caretaker neglect.”

Amusement Park Injuries

Amusement Parks are great fun for children and adults. The biggest amusement park in our area is Carowinds. In addition to Carowinds, there are carnivals and fairs all throughout North and South Carolina, where amusement rides are set-up. The owners of these amusement parks and everyone who is in charge has a duty to act with reasonable care in order to protect people who are riding on all of the rides.

Unfortunately, there are times when the design of the ride is not safe. Other times there are malfunctions on a ride that ultimately create harm and injury for the riders. Throughout the years we have handled many cases involving serious injury to individuals who have been injured on a multitude of amusement park rides. Our first concern is for the safety of all of the individuals participating on the rides.

Medical Malpractice

Medical malpractice results in injury or death from the failure or lack of providing proper professional medical, dental, or other health care services by a health care provider. Bringing a medical malpractice claim in North Carolina is extremely challenging. Selecting a law firm like ours, with a depth of experience in successfully trying medical malpractice cases, is absolutely critical.

Technically speaking, under North Carolina state law, the defendant in a Medical Malpractice case cannot be held liable unless it’s proven that the care the defendant provided was not in accordance with the standards of practice among members of the same health care profession with similar training and experience. The Law Offices of William K. Goldfarb is not afraid to tackle difficult medical malpractice cases, and try them in court. We have a local and national network of expert witnesses who can provide credible and effective testimony on behalf of our clients.

In 2011, the North Carolina Legislature made severe changes to the medical malpractice laws in North Carolina. These changes give doctors and hospitals, and their insurance companies a huge break and significant advantages over injured patients. It’s now more difficult for the injured patient to bring claims, and even more difficult to get compensated for these claims. Unfortunately, the legislature has unfairly determined that an injured patient’s pain and suffering can amount to no more than $500,000.00 when negligently harmed by a medical provider. As a result of these legislative changes, this law firm can only accept medical malpractice cases involving catastrophic injury or death with extreme financial loss to the injured person which exceeds $1,000,000.00. Due to these legislative changes and the extreme cost of bringing a medical negligence case, this law firm can only bring cases where the potential recovery includes the $500,000 for the pain and suffering and an additional $500,000 for past and future medical treatment or loss of income. We would like to attempt to help others who are harmed, as we have in the past, however, these legislative changes have made it practically impossible to do so. Therefore, before calling this law firm about a potential medical malpractice case, please keep the above criteria in mind with regard to whether we would be able to help you or not. If you do meet this criteria, please contact us today so we can determine if we can help you.

Sample Case

A Wilkes County resident was undergoing a routine procedure for reoccurring polyps in her bladder after suffering from cancer. During the surgery, a medical provider accidentally flushed her bladder with scolding hot liquid saline, which caused third degree burns inside of her bladder. As a result of the medical provider’s careless act, the woman was forced to endure excruciating pain and additional surgeries to remove her bladder completely, changing her life forever. Sadly, she will have to live with a urostomy bag for the rest of her life.

Hip Replacement Cases

Hip replacements are a surgical procedure where the diseased part of the hip is replaced with new artificial parts. This is done to help individuals with mobility, hip function and to relieve pain. Unfortunately, in the last several years, there have been numerous recalls for hip device implants due to faulty devices and/or metal on metal devices. These devices release metal into the body which can damage the bones and tissues surrounding the hip joint. These faulty devices also cause loose implants or loss of mobility, inflammation, infection, and even damage to the heart, kidneys, thyroids, and nervous system. A revision of the hip replacement is required due to metallosis and the damage it has caused.

There are several manufactures that have manufactured metal on metal hip replacements and have sold these replacements to orthopedic doctors in order to be put into their patients. All of these manufacturers who have the metal on metal hips have potential product liability claims arising out of the metal that is released into the blood stream and for other complications surrounding these metal on metal hips.

We handle all types of hip replacement cases including but not limited to: Stryker, Zimmer, Wright Medical Technology, BioMet, Smith & Nephew, and DePuy. These are often times referred to as defective hip implants.

Please contact us if you have a defective hip replacement.

Transvaginal Mesh

Transvaginal mesh is a net-like implant used to treat pelvic organ prolapse and stress urinary incontinence in women. The product design and implantation technique contributed to serious complications, such as erosion and organ perforation. The Law Offices of William K. Goldfarb has successfully represented clients suffering from the faulty product design and implantation technique that contributed to serious complications, such as erosion and organ perforation.
